Notice Rights

The minimum periods of notice an employee is required to give and is entitled to receive are governed by statute. A contract of employment may provide for more than statutory notice it cannot provide for less.

Therefore unless the contract states differently, once a person has been employed for a month or more:

  • An employee is obliged to provide their employer with one week’s notice to terminate their contract of employment
     
  • After one months’ employment an employer must give notice as follows:
    • More one month, but less than 2 years' continuous service one week's notice.
      2 years' continuous service or more one week's notice for each year of continuous employment, up to a maximum of 12 weeks.
