Capability

Capability is defined within the Act as being assessed by reference to skill, aptitude, health or any other physical or mental quality.

A dismissal on the grounds that the employee lacked the required skills or aptitude to perform the job for which he was employed, will be potentially fair as will a dismissal on the grounds of genuine ill-health or injury.
