Legal Restrictions

Legal Restriction applies where it would be unlawful to employ or continue to employ an employee because of a statutory bar. Examples of this include:

  • An employee working who does not have the legal right to work within the UK.
  • An employee working within licensed premises who is under the age of 18.
  • A person who is employed as a driver, who loses his driving licence and cannot be reasonably deployed elsewhere for the duration of the driving ban.

Where legal restriction is the reason for dismissal, there is no requirement to follow a formal dismissal and disciplinary procedure.
