Some Other Substantial Reason

This applies where a dismissal is fair but does not fall neatly into one of the previous five categories. For example, if a member of staff has been imprisoned for a significant period of time; or, if the company premises were struck by lightning and subsequently burned down.

Once the reason for dismissal has been established, the Employment Tribunal will require to satisfy itself as to whether, given the circumstance, the employer acted reasonably or unreasonably. In other words, if the 'punishment fits the crime' and Tribunals are not entitled to substitute their own views when deciding if the employer's decision to dismiss fell within what is commonly known as the 'band of reasonable responses'.
