Unfair Dismissal

The Employment Rights Act 1996 lists six potentially fair reasons for dismissal which are:

  1. The employees conduct
     
  2. The capability of qualifications of the employee for performing work of the kind he was employed to do.
     
  3. Redundancy
     
  4. A legal restriction making continued employment impossible
     
  5. Retirement
     
  6. Some other substantial reason justifying the dismissal of an employee
